Itciusal of a Firm to Pay a SMller of WciBUts and Measures an Extortionate Fee niianly Conduct Alleged Against the Official. On a proceeding iustifcutod before Justice 3uok by Garrett Garrison, Eastern District Sealer of Woights ana Measures, foj the recovery of fees to the amount of $5 from Messrs.

G. C. Hotcbklss, Field A of First and South Niutb streets, a brief examination yeaterdBy dovelopud Eomo slight irregularities. About tho middle of June tho firm was called upon by tho official designated, who tested and rogulatod four beam BcaleB. Week before last Mr.

Garrison presented a blU In duo form by which it appeared the firm was indebted to Garrison and Fox, sealers for tho Fourth Congressional District, In Hie sum of J5. Payment ot this was rcfUBDd for tho reaBon that tho chargo was ex tionato, the firm having in previous years paid bnt 43 for tho same official act, consequently tho suit at law trl0! A Tho plaintiff in respouso to his counsel, air. J. A. Armstrong, statsd his case formally, testifying that ho charged no more than the CUSTOMARY FEES.

On cross examination by Mr. Robert Payno for the dofcuse, Mr. Garrison damaged his oase ny tho admis eiou that ha and Mr. Fox were virtually partners and divided the fees received. Without going further into the merits of tho case a motion to dismiss, for the rea eon thatGarrrison and Fox should havo brought tho suit tolntly, was granted by tho magistrate, and tho cause dismissed.

Mr. Payne remarked he was also prepared to show that, by tho law regulating the amount of feos to be charged, tho sealora wero entitled to but forty cents. The clause reads that ten cents shall bo tho fco for testing eaoh scale beam and five cents for scaling each weight. In this iustanee not a weight had been sealed. Km ij Snip Made LEIKK, Black Hock, July 20, 1817. Tho steamer Now Amsterdam, Captain ex Alayor Gunther, arrived last night at midnight, and made it very lively for a timo with rockets, candies and signal lights. Tho morning broko ilh a heavy leaden sky, and a very light breezo from the South. The starting gnn was fired at 6:45. Thero was a merry contest to aeo" which boat would get off erst.

Tho Niautlc and Kate led the fleet and the schooners Rstollo and Madileino brought up the rear. After getting out into tho Soun tho wind died out ontlrely, and tho lazy boats flappod their swaying sailB heavily. Tho Bun came out a 9, and at 11:20 the dodred breezo sprang up but soon died out. At a o'clock anchored off tho Georgo Illack Bock. Tho proprietor sent off a mossonger with an invitation to a hop in the dining room or the hotel this evening.

A meeting of the captains was hold on the Madeline, and it was voted to respectfully decline the invilution, and at 4X sail for Shelter Island. 0. K. THE 'IHlltTEGNTfl. Austen In Mis New Quarters.

Rotes on Military Topics). Colonel David E. Austen, having officially accepted tho Colonelcy of the Th'rtoonth Itogiiuont, met the officers of that organization last eTcni the occasion bolng the stated meeting of the Council. A very hoarty reception was accorded the now commandant by (he Field Staff and Line officers, all of whom wore present with one or two absences rendoreu necessary by imperative business engagements or illness. On being iotroduced to the Conucil by Lieutenant Colonel Beadle, Colonel Austen made a brief address outlining his views In rosard to tho management ola regiment and a company, and the duties of officers in that connection.

Ho desired to set clearly before tho members of the Council that they must rely upon themselves; that prosperity in tho future depended upon their own eiorlioos individually and collectively, and that In hearty co operation and cllectivo work lay the secret of true success. Afterward Colonel AuBton inspected the books and papers of the rogimeut In company with Major Syme, with a view to making himself acquatutcj with the internal economy of the organization. It is expected that Colonel Austen will formally take command of the Thirteenth within a few as ho is only waiting the conclusion of the preliminaries necessary to the turning over of too properly of tho ytato held by the Forty seventh Itegimeut, for which he i undor bonds, and tho recoipting for the same by tho authorities, which will terminate his oflkial connection with his old command. Considerable interest has been manifested as to tho composition of tho Staff of the Thirteenth, and as to whether Colonel Austen would make any consiuerablo chango in the present corps. It ib not believed that tha SlatI will be disturbed, as tho Bovcral positions aio filled by efficient and faithful officers.

In tho matter of tho tactic iuslrnoliou of the regiment, however, it is probable that what is known as Tho Bnggs' Manual will be laid aido, and a return made to Upton, who will bo followed strictly, with a single change the method of executlug "fix" and "unfix bayoDots." In nil (ha Companies of tho Thirteenth thero is groat enthusiasm recruiting has boon stimulated, gain of sixtctn men is reported within tho past week, and on all siJea tho prospecl3 are encouragingly bright. OFFICE. JULY 21, 1877. INSURRECTION. Eailroad Employes in Organized Revolt in Four States. Frlghtfnl Collision Between the Troops and the Hob in Baltimore The Rioters Attack the Troops and are Repulsed With Bloodshed.

The strike on the Baltimore; and Ohio Railroad has extended to other roade, has resulted in a bloody" collision between the Maryland militia and tho mob, in whioh many lives have boon lost, and tho dldlculty has assumed tho proportions ot an organized insurrection against law and order In parts of threo Statos. The' uqws received yesterday from Cumberland, announcing that all freight trains had been stopped, and that their orowa had been forolbly taten from them by the rioters, determined Govornor Carroll to tako Immediate and effective action. Iu the afternoon an order was iecued by birn that tho Sixth Regiment should proceed at once lo Cumberland to aid in tho suppression of the lawlessness existing on tho line of the Baltimore and Ohio Road. Governor Carroll also issued a proclamation calling upon all citizens of the Stato to abstain from acts of lawlessness, ond aid tho lawful authorities in the maintenance of peace and order. Shortly after tho fsauo of tho order to the Sixth Rofrimont tho raon wore under marching orders, fully armed and equipped for duty.

Great excltonront was caused at half past Elx o'clock last evening by tho City Hall bell ringing out No. 151, which is tho alarm for calling out tho militia. This was tbe first occasion In tho history of Baltimore that this alarm had been sounded, and, owing to tho existing stato of affaire, every ono was familiar with ita moaning. Tho Fifth aud Eighth RogfmontB, which compose tho First Brigade of tho Maryland National Guard, had, for some fow days past, boen about tluv.r armory, to ba ready In case of. any emergency.

Baltimore and other streets of tho city had boon crowded during the day with thronga of citizens, anxiously watching the bulletin boards at tho difforent newspaper offices and discussing the situation. Ao tho alarm pealed forth tho crowds made their way toward tho armories of tho difforent rogiineuls. That of tho Sixth is at Front aud Fayette otroots. and in a neighborhood whioh is inhabited by tho poorer classes, and much of the rough element frequont it. Within half an hour otter the call had boon sounded a crowd, nurnborlng nt least 2,000 men, women and children, surrounded tbe armory ond loudly oxprosBed their feelings against tho military and, in favor of tho elrlkors.

At half past seven the 6trools loading to tho armory worn mass of struagHng, shouting aud cursing humanity. Tho eight of a man in uniform endeavoring to got into fho building was the signal for an outbreak, and ho was tUBhod upon, noizcd and thrown over a bridgo into Jones Falls, a stroam which runs through that section of tho city. Others wero thrown over tho heads of tho surging maes and wero glad to cscapo with slight Injuries. At thiB Juncture, some ono THREW A nitlOK AT THE SOLDIER ON GUARD at tho door of tho armory. This was a signal for a perfect shower of misBilcs, which soon destroyed (ho windows and doors of tho building, and injured notuo of tho men.

It was siiggestod hy eomo ol tho officers that a bayonot ohDrgo would compel the mob to retire, but the suggestion was not actod upon by tho Colonel, who ordered the guards withdrawn from tho door, under tho Impression that it would strivo to quiet tho mob. On the contrary this notion was recolved with shouts of derision and triumph by tho orowd, who oontlnuod to hurl bricks and stouos and firo pistols at tbe doors and windows of tho armory. Tho whole availablo police force of fho district wero promptly concentrated at this spot, but wero utterly powerleus to quell tho tumult which increased momentarily. At 8:15 P. M.

tho preliminaries for leaving tho armory wero concluded, and Colouol Fetors decided to march his command to Camdon Station, whero they ad boen orderod to roport by General Herbert. Tho men wero each supplied with twonty rounds of cartridges and armed with breeoh loading Springfield rifles. They numbered about one hundred and fifty men and marched out with loaded piocos. Tho only means of exit wob by a door whioh only admittod of their passing out by twoB. Ab they reached this door tho order was given' "Stoop down, boys which had hardly bean uttered when their appearance waB greotcd with a renewed shower of missiles, Intorsporsed with shots from revolvers and othor small arms.

At first the citizen eoldleiy wavered, but, promptly responding to the oonimauds of thoir ofllcers, thoy marched eolldly out into tho street, pressing boforo them tho 8HOUTINO, INITJEIATED MOB. Ab thoy filed in a westerly direction across tho bridgo over Jones Falls tbo orowd pressed upon them, and continuod to assail them. The eight of one of tholr number stricken down with a paving stone caused somo of tho members of the regiment to flro into tbe orowd. Too first rolloy consisted of but a few straggling BhotB, but had the oHoot of causing the orond to fall back toward Gay stroot. At tho cornor of Gay and Front Btroots shots wero again exchanged.

Whon tho troops turned Into Baltimore street, one block south of Front, tho firing in oreascd. At the corner of Halliday and Baltimore streets, and in tho blocks in Baltimore, between Halliday and Calvert streets, whoro all tho newspapers offlecH aro situated, THE VOLLEYS WERB CONTINUOUS, and the scone was ono never beore equalod in iho city. Tho etroets at thiB point wore literally flowing with blood. BtoreB wore hastily closod, and frlghtenod citizens speedily betook thomeolvefl to back strcots. Tho regiment proceeded to Howard street, through which It enfUadod lo Camdon Station.

Tho Fifth Regiment formed in Its armory in Howard stroot, and at seven o'olock marched down Eutaw to Baltimore afreet, and whon In front of the Eutaw Hotel woro attaokod by a mob, said to bo striking box makers. No shots wero firod by tho militia. At ten P. M. the oxcitomont attending tho terrible shooting by tho Sixth Regiment 'was fierco, and Iho orowd on Baltimore etrcot for several squares from South street each wax incroased, rendering tho sidewalks almost impassable.

In front of the Middle Polico Station, on Fourth street, nearly opposite the City Hall, whero most of tho dead and wounded havo been takou, the way is blocked by an excited mass ot eitizons eager to learn tho namcB of tho unfortunalo men. In this station there aro now lying elht dead bodies and two wounded. Tho following aro tho names of THE DEAD, as far as ascertained: Thos. 11. Byrne, Roglatrar of tho Fifth Ward, shot In tho head and killed Instantly; agod forty yoara; resided on Gay street.

William Moran, a newsboy, aged fourteen years Bhot in tho hoad'and killed instantly, at the cornor of Baltimoro and Halliday strerts. Lewis Janowitz, a young shoemokor, who lived at 4 Albemarle street. Cornolius Murphy, shot through tho spinal column, aged 23, an Arab aud four yet unrecognized. Wounded Jamoa Hoke, agod 25, laborer in bottling establishment, shot through tho buttock, tho ball coming out lu the groin, dangerously. Georgo Koinp, bucliBtoi', aged 211, shot through the thigh at Ihe cornor of Baltimore and Frederick streets, whtlo on hio way home, sorioualy.

The wildcat rumors aro afloat in regard to tho number killed. One is that several woman woro killed and bornu off. Tho depot at Camden was ect on firo, and It Is said that tho railroad offico has bon cleaned out. Tho telegraph office in the dopot building hae boon destroyed, the wirca cut and the Instruments romoved. The flro was extinguished at cloven o'clock with but little damaye.

The lulegraph ofilco cleaned out waH tho dispatcher's oflice on lo htation platform, and not the ofilco in the main building. All tho Baltimore and Ohio wires have boon out. J. HB, BEECHKU'8 SIKH (IKY REFRESHED. To the Editor of the Drooklvn Katie: I have recently returned to the city and find that a controversy has arisou in Plymouth Church in consequence of ono of ita members Interrupting Mr. Beecher during tho exercises. In tho Fall of 1801 I beard Mr.

Doeohcr for tho first time, and romombcr distinctly the circumstance and occasion of his using words very like unto the following "1 believe thst any one of this congregation has a right to get up and ques mn qhotild 1 bsv anvthlniz which ho does not un derstand. Thoy did bo in Ihe tinr. Pant, and I don't see why they should not do so now." Tbo substance I will vouch for, although tho words may be slightly different. Mr. Beoohcr's remarks wore called for by tho following circumstance He bad received an anonymous letter that day asking him threo questions, ono of which was, "Are we not directly breaking ono of tho commandments in observing 8unaay as tho Sabbath instead of Saturday?" At this moment I forgot whut the other two questions wero, but in announcing tha receipt of tha lattor Mr.

Beeohor said he would make that the subject of his dlaoourso for that evening, and regretted that the letter was anonymous, because he be. lleved any ono of his congregation had the right, to. I have not seen any allusion to this sermon during the eontrornray, bnt perhaps this may tend to bring tho subject to the recollection of others, as too churoh was protty noil tUl that evaatiig.
