Ex Justice Brown's Decision Likely to Be Sustained Nassau's Share Less Thau a Million Dollars. (Special to the Eagle.) Jamaica, L.

July 0 Ex Justice Charles P. Brown, acting under an appointment by Justice Clearwater of the Third Judicial Department, as referee in the matter of the division of the Queens County debt, as between the Nassau County towns and New York City, has handed down an opinion holding that the division of the debt should be on the basis of the assossed valuation of Nassau and Queens borough towns. Upon this basis the proportion of Nassau County will be $985,033.32. and the share of New York City The opinion is based upon the provisions of Section 1,583 of the charter of the City of New York. The decision is looked upon as a notable victory for Nassau County and the opinion is fonejally expressed that it will be sustained the Judges of the Third Department and by the Court of Appeals.

In the words of a prominent lawyer of Nassau: Justice Brown, formerly the presiding justice of the Second Department, is held in high repute as a jurist and a constitutional lawyer and great value is attached to his opinion." Under the contention of Queens County and New York City authorities it was claimed that that portion of the debt incurred in the building of the Queens County roads should be apportioned upou the basis of the amount expended in each section. Were the court so to decide the proportion of the debt chargeable toNassau County would have been about two millions of dollars, or nearly 10 pc cent, of the entire assessed valuatiou of the county. Such a staggering burden it was said would prove a blight upon the country and involve such heavy taxation as to seriously affect real estate values and the growth and prosperity of the new county. The anxiety of the Board of Supervisors concerning the decision of the courts in regard to this matter has paTalyzed the board as to any action concerning projected bond issues and concerning the building of the proposed new court house and county office, to be erected at Mineola. In fact, this feaT is tho key to the solution of much of the apparently inconsistent course pursued by the board, which Cot only refused to take any action in regard to the new court house, but has consented to spend only the smallest amounts for any other necessary public affairs.

Frederick Ingraliam, who as counsel for Nassau County has successfully conducted this suit since its commencement, says: "I feel quite confident that we shall win on appeal and the case is in such good shape I think it will be decided by tho Court of Appeals oy January 1 next." County Judge of Nassau County Robert Seabury says: "The opinion of Justice Brown is a notable victory for Nassau County, and I feci that the Board of Supervisors would now be justified in calling for bids for the new oourt house. It might make a difference of or 4 per cent, in the premium obtained on tho bonds whether they were issued now or whether the board awaited the favorable decision of the Court of but they wouia oe jusnnea in at once going ahead with tne work, as. should a occur in the nres ent unsafe wooden building much more than tne small sum involved in tho premium would probably bo lost in the destruction of valu able public records." July The sum of $1,500 in bills vanished from the desk of George Rauscher, a florist, of Metropolitan, last week, and yesterday in Magistrate Healey's court at Flushing Joseph Brcit was accused of having stolen the money. Rauscher kept it in his house in two strong boxes hidden in a desk. During his absence one day last week young Ilreit was seen about, the premises and when Rauscher returned he found his money boxes gone. Thoy were subsequently found in the hay loft, where they had been broken open and rilled. Magistrate Healey held Breit In $1,000 bail to answer to tho grand juryon the charge of grand larceny.

GREEBTPORT WANTS A FACTORY. Greenport. L. July 6 A mass meeting of tho citizens of this place was held In Village Hall last night to take measures looking to the locating of a factory in this place. Tho Idea is for the taxpayers of Greenport to raise the sum of to build a factory property and accept proposals from outside manufacturing concerns to use the building for a manufacturing enterprise.

Bastport, July 6 Mrs. Chauncey L. Hal lock of this village appeared before Justice Riley Howell at East Moriches yesterday afternoon to answer charges of being incompetent to care for her children. Tho hearing was a long one and the Justice held that there were no grounds for the removal of the children from Mrs. Hallock's care, and she will be allowed to keep them.

July The marriage of L. W. Overton of this place to Miss Harriet Maverick Hogan of Greenlawn has just been an nounced. The groom is 22 years old, a thrifty mechanic who conducts a bicycle shop on tho main highway at Peconic, and the bride lived at Greenlawn, with her mother, Mrs. Sarah Hogan.

The marriage is tho result of a correspondence that extended over six months and until two weeks ago neither had seen the other, though photographs had been exchanged. Then Overton visited Greenlawn and the two met for the first time. Mrs. Hogan was apprised of the situation and as the young people suited each other and the mother made no objection the party visited the office of Justice Loundes of Huntington and there the marriage took place and the young couple started ou a honeymoon trip. A pretty cottage In the village has been thoroughly fitted out by the groom and they will take possession the latter part of the comin week.

APPLICATION" GRANTED. The Long Island Road May Close Some Atlantic Avenue Stations. Albany, July 6 The Board of Railroad Commissioners has granted the application of the Long Island Railroad Company for the discontinuance of tho following rapid transit stations on the Atlantic Avenue Division: Chester Park, City Line, Norwood avenue, Rockaway avenue, Saratoga avenue, Ralph avenue, Troy avenue, Kingston avenue, Brooklyn avenue. Grant avenue and Vander bllt avenue. The board also consented to the discontinuance of the Bedford station, on condition that all trains stop at Nostrand avenue.

The board also consented to the discontinuance of the Van Siclen avenue, Pennsylvania avenue and Howard House stations, on condition that the three latter named stations should not be discontinued until a new station is established and in use at Bradford avenue. It is the opinion of the board that the people in the vicinity of the present stations are well accommodated by existing electric and elevated railroads, and that the discontinu ance of the stations is proposed in order to inaugurate a better class ot service on tne Long Island Railroad to and from points beyond. In the place of the Howard House, Pennsylvania avenue and Van Siclen avenue stations, the company, in a letter to the board, under date of June 23, proposed to locate a new station midway between LInwood street and East New York, at Bradford avenue. This new station, it appeared to the board, would accommodate those now using the Howard House, Pennsylvania Avenue and Van Siclen avenue stations. WHO KILLED JOHN" BTJNNP Sheriff Wood at Bay Shore With a Detective and a Clew.

Bay Shore, L. July 6 Coroner W. S. Bennett, assisted by District Attorney Walter H. Jaycox of Patchogue, began the inquest here yesterday, on the death of John BUnn, who was found dead near the baggage room of the railroad early yesterday morning, as told in the Eagle last evening.

The jurymen are Irvin Long, Eugene Strong, Frank Call, Waite Burr, Henry L. Patthey, Albert Boyce, Henry Rowland, William W. Hulse, John L. Matthews and Lean der Homan. Nine witnesses were examined and gave testimony as to the discovery of the body, its condition and when the man was last seen alive, but nothing was elicited to connect anyone with the crime.

Among those who testified were Estelle Williams, Jennie Miller. Tony Moon, Elisha Thomas, Isaac Jones, Ira Cuffee, Henry Hincksman, George Holmes of Islip, all colored, and Mrs. Pad losky. A verdict will probably be reached this afternoon. Sheriff Wood arrived here to day with a detective and they made a careful examination of the depot grounds and questioned some of the Coroner's witnesses.

July A meeting of the Jamaica sewer commission appointed by Justice G. J. Garretson, to take testimony and to assess damages in the matter of condemning land for a sewer disposal plant, to bo located on the Bergen farm, met at tne Jamaica Town Hall to day and took further testimony in regard to the valuation of land.

Commissioners James A. Renwlck of Flush ing, James Ingraham and George Davison of Jamaica were present; also, ex Congressman James W. Covert as representative of the City of New York and Frank Harvey Fields of the property owners, and a number of witnesses. Mr. HacClelland to Leave Im manuel Church, August 1. The resignation of the Rev. George L. Mac Clelland, tendered to take effect August 1 next, was formally accepted at a meeting of the Immanuel Presbyterian Church of Flat bush last night.

This is the second time the church has voted to accept the pastor's resignation. The previous meeting was declared illegal by the Presbytery because the call for the meeting was not read from the pulpit of the church on two successive Sundays. The vote last tilght. unlike that of the other meeting, was unani mous, the fourteen members present voting in the affirmative. The Rev.

Dr. C. T. Berry, pastor of the Glenmore Avenue Presbyterian Church and moderator of the Flatbush cnurch pro tem presided, and Oscar W. Smith recorded.

Logan and W. F. Moore were appointed commissioners to present the matter to tho Presbytery of Brooklyn. HELD FOR WIFE BEATING. Henry Rauer, aged 32 years, of 417 Malbone street, was before Magistrate Steers in the Flatbush court accused of assaulting his wife, Pauline, on July 4.

He was arrested yester day by Roundsman Davies. Mrs. Rauer is in the Kings County Hospital and said to be In a serious condition as the result of the as sault, in default of $500 ball Kauer was sent to jail to await examination. FELL FROM FIRE ESCAPE. Mrs.

Nettie Gurney Fractures Her Skull and Is Removed to the Hospital. Mrs. Nettie Gurney, 37 years old, who lived with her husband and three children on the top floor of the brick flat building at 106 Thirty ninth street, fell from the lire escape this morning into the yard, a distance of twenty feet, and fractured her skull. She was removed to the Norwegian Hospital by Ambulance Surgeon Krafft. The fire which led to the accident broke out from some unknown cause.

It was discovered by Mrs. John Hand, whose husband keeps a grocery store on tho ground floor. Mr. and Mrs. Hand live in the rear.

Mrs. Hand was awakened by hearing a noise, which she supposed was a rat in the wainscoting. Hasty investigation proved that the building was on fire. An alarm was given and all of the six families escaped without injury with the exception of Mrs. Gurney.

The Gurney children and the father got out of the building, but Mrs. Gurney made a mls stc and fell to the yard. The building was damaged to the extent of $500. RECRUITS FOR PHILIPPINES. Commissary Fund Placed at Disposal of Lieutenant Langdon.

Lieutenant Langdon, Eighth Infantry, recruiting officer for the United States Army in New York City, has received notice from the War Department informing him that a commissary fund has been placed at his disposal. Tho headquarters of Lieutenant Langdon are in Brooklyn and this notice is interpreted to mean that the volunteers recruited here will be uniformed and fitted out at the same time. Recruiting officers are required to make special reports upon enlistments for the Philippines and each week a list of these recruits is forwarded.
