Hildreth then sued Nelson Holden for the value of tho wagon, $200, and for dam ages for seizing it. At four o'clock Wednesday afternoon, according to adjournment, Demas Strong, appeared in tho Special Term of the Supreme Court, before Justice Gilbert, on behalf of Supervisor Coe, in the matter of the mandamus sought by Controller Schroe 4er against the Joint Board of Aldermen and Super visors, to compel them to insert in the budget for the ensuing year the sum of 26,060.86 for the pnrpose of meeting bonds issued by the city for street improvements.

Mr. Strong presented two points to the attention of the Court. The first was that the Joint Board had now no legal oxietence, haviug been legislated out of existence by the new charter. Consequently no mandamus would lie to compel a body of men to do a thing which they had no authority to do. The second point was that in case the court Bhould hold the Joint Board to be sbll legally exiBtent and au thorized to perform the functions which they had formerly, then he was prepared by affidavit to prove that tho matter of inserting the Bum spoken of in tho budget waB still under consideration.
