The matter, he said, could only bo proceeded with by declaring the rooms a nuisance from day to day. VIRGINIA SUITS DISMISSED. Efforts of Enemies of New Constitution Come to Naught. Richmond, November 29 The argument in the proceeding of John, S. Wise to invalidate the new Virginia constitution was resumed in the United States Circuit Court to day, Chief Justice Fuller sitting with Judge Waddill.

Attorney General Anderson spoke for the commonwealth, addressing himself largely to the point raised by complainants, that the state was barred from re jtrlctlng the suffrage as It had done by the reconstruction acts. He was followed by James Hayes, colored, of counsel for complainants, who made a strong plea for the cf his race. This afternoon the court dismissed both suits on the ground that it had no jurlsdic 1846. Also with the earth at the base of the monument which we are erecting in front ol old Fort Nervine, constructed and commanded by his aide de camp, Midshipman William P. Toler.

Also from San Jose, vhere the flag was raised by the Americans there, July 16, 1846, which he gave them for that purpose. Also from Portsmouth square and the Presidio of San Francisco, where Captain Montgomery of the sloop of war Portsmouth landed and raised the American flag by Sloat'e orders on July U. Also from the foot of the flagstaff at Sonoma, where the Bear Flag was hoisted on June 14, 1846. by the Bear Flag party, and which was hauled down and the American flag hoisted In its place on July 11, 1846, by order of Commodore Sloat. Alto from Sutter's Fort at Sacramento, where the American flag was hoisted on the same date.

Admiral Sloat was burled On November 30, 1S67, and the Secretary of the Navy has been requested to send a naval detachment to unite with your committee on November 30, and we have asked that Captain James Dexter Adams be ordered to perform that duty, as he was the last naval officer to raise the flag at Montery. The society has received the earth mentioned In the letter and will send a committee to Greenwood Cemetery to day to sprinkle the earth as requested, and will on their own account place a wreath of flowers on the grave. The California Society of New York held Its monthly meeting tt the Waldorf Astoria last night and during the course of the meeting the Rev. Dr. Robert Mackenzie, the president of the society, said that he had received a letter from the Sloat Monument Association of California requesting the society to send a committee to represent the association in a visit to the grave of the late Rear Admiral Sloat in Greenwood Cemetery today.

The letter reads in part as follows; The Rev. Robert Mackenzie, D. D. Dear sir You are most respectfully requested by the officers and members of the Sloat Monument Association of California to appoint a committee from your California Society of New York to act for and in behalf oT this Sloat Monument Association on the 30th instant, to visit the grave of the late Rear Admiral John Drake Sloat, U. S.
