Conclusion op the Riot on the Mati'lower. The examination of the crew of the ship Mayflower, for a riot on board that ship on the 5th instant, was concluded yesterday at a late hour. There was no further testimony than that already published; and the case was summed up on the part of the prisoners by Mr. Parmeutcr, who con. tended that the offense of riot had not been committed, inasmuch as there was no unlawful assembling of the men, and that the first physical demonstration was made by tho second mate of the ship by striking Neibher with his fist in the face, who was afterwards pursued by the third mate, Kinvin, across the deck of the adjoining ship, and stabbed three times with a dirk knife, which had been put into his hand by the captain of the Mayflower, and afterwards returned to him by Kinvin, all of which was sworn to by five witnesses, nut one of whoir had been impeached, nor had any attempt be made to that end; besides Parker, the secoi.J mate, admitted upon the stand that he struck the first blow.

He also contended, as there was uo offense as riot known by the statutes of New York, we were governed entirely by the old English common law in the trial of a riot, and before there could be any riot, there must be some resistance to lawful authority, some attempt to oppose the officers who are there to preserve the peace. To sustain this position, he read from Ku. st. ll on Crimes; Eoscoe's Criminal Evidence, and other authorities, and insisted that, from all that appeared on the evidence, this was only a fight bet ween the 2d mate and Neither, and that theothers went forthepurposeof rescuing him from the officers and that this prosecution was instituted by the shipping agent, and others from New York tor the purpose of screening the third mate who had made an attempt upon the life of Neibher, instigated by the master of the Mayflower, who upon the witness 6tand althongh the prosecuting witness, refused to say whether he gave Kirwiu the knife, for fear it might tend to crimiiuite ldmsdj and yet he was sworn to tell the whole truth, and he asked that the charge of riot might, be dismissed. Hawkins who appeared for the prosecution made an able argument on behalf of the people, and read from several authorities to show that the crime of riot bad been committed and that the parties accused were the guilty parties, Uo said the third mate was fully justified in attempting to take the life of Neibher, and that if he had not have done so the officers of the Mayflower would have been murdered and he most earnestly appealed to the Magistrate to hold the prisoners lor trial. Justice Cornwell said as the Grand Jury was now in session, it would lie perhaps better to lay the whole matter before that body, and he would Bee that the papers went up at once and that the whole affair was properly investigated and the prisoners were remanded to await fhe result. John Stryker was moved as tomporary chairman by Mr. Cagger. and knocked down by one of Wood men. He was not hurt, though knocked off the platform. The exeitliment was most intense at the present moment.

Afler tremendous excitement Mr. Stryker in dumb show adjourned his convention and Mr. Wood moved the regular motion for committees and made a speech bitterly attacking the disorganisers, as ho called those who had left. The motions were all put and declared carried. Mr.
