aud also held the position of Commissioner of tho Board of Enrollment, but at tno tune spoaeu oi no was uuuuuuu in Fort Warren; Mr. Cheshire went into tho Provost Marshal's offlco at the organization of tho Board, and remained there up to the time of his arrest; Mr. Cheshire told mo that when he was first arrested he was taken to Washington; he said ho did not know why ho was taken there; he was subsequently tried and alterwards dismiBBcd on parole; it was after this time that ha was imprisoned at Albany ond at Fort Warren; I don't know that I did anything to procure his liberation, as it was not iu my power; don't know if I signed a petition to gethim out; don'tinow that apotitiou would havo got him out; prior to the last six or eight years, Mr. Cheshire was clerk in a wholesaia grocery store in New York. I don't know positively what business Wm.

Ho was out of employment about two'montbs before ho wout into the Provost Marshal's ofilce; and he has beou a member of the Board of Supervisors for four years past; he Iibb recently beon appointed clerk in the Assessors office; I was Alderman of tho 13th Ward in 1837, and since thot time, I have been in the Sheriff's office, and am now Port Warden; when Mr. Wooley spoke about suckers, I did not think it applied to mo; 1 told Mr. Cheshire, that if anybody called me a "thief" I would mako him prove it, or I would not expect my friends to associate with me and bo insulted for doing so. Ec direct I asked Mr.

Cheshirewhat tho charges against him were, but had never been ablo to get them; be told mo that he had never had a dollar of O'uitxl States money in his hand, and that ho had never wronped a man out of a dollar in his life; he said bo bad never made a dollar out of the governmont money in Ills possession; he said that bethought Baker's squod meant to make a Bcapegoat of him; he told me tbat'ho had Been that Court Martial at Washington, aud that he wob Bure to bo convicted of something, in consequence of tho escape of Waldron; as far as I know no application has been mado for auy pardon for Mr. Cheshire; Mr. Cheshire told mo that Nathans bod visited Mb house ond ransacked his papers; after his return irom Fort Warren Mr. Cheshire told mo that ho had got an unconditional pardon, that tho goveruinout opened the door and told him to go. CrOBB examined Ho told mo alter his trial before tbo Court Martial, that ho didn't like that modo of trial.

Ho told me that he was convicted. OASE FOB THE DEFENCE. Tho testimony of this witness closed tho caso for tho prosecution, and tho case for tbo defence was opened by Mr. Thompson. He claimed that the dofeuce would show the position of matters in the Provost Marshal's office, nnd that this was a moro merconarysuit for money.

Complainant was arrested and convicted, and thiB was a matter of public notoriety known to all the community thot tho witncBS for tho complainant had gono over to Mr. Wooloy to pump," in order to get aomo basis for making a complaint; that tho name of Mr. was not used in tho conversation alluded to at all; that Mr. Cheshire had been the Bubject of similar attacks for a long time before, aud had notnoticod it, and ho claimed that unless men wero allowed to canvass the character of public men, there was no means of knowing who were proper men for public offices. Thoy would show that he hod taken bribes; that $1000 had beorr paid to him at oao time for tho run of tho Provost Marshal's office; that from a position of indigence ho had como to acquire Budden wealth.

Thoy would show tho machinery of this Provost Marshal's office. Thoy had certificates for hand money, and thoy would show large numbers of these certificates goininto tho pocket? ol Mr. cnesnire; mar money ueiurp; tue recruits found its way into tho pockets of Mr. Cheshire; that no ron could, yet into the Provost Marshal's office unless those who paid Mr. Cheshire, and that ho had au arrangement with Nathans aud Bitterly aud others, by which nine tenths of tho business in that ofilco was made to run in one channel, ond that Mr.

Choshiro hod his sucker in that channel to get his share out. The first witness called for tho defence was Honry M. Dixon, who testified as follows Am a plumber; know tho parties to this BUit; was presout at tho conversation between Mr. Wooley ond Mr. Wilson, in front of Mr.

Wooley'SBlorc in South Tth street; Mr. Wilson catuo up ond said, "I'm going to tako Martin's measure;" ho had a tape line in his baud; Mr. Wooley said, "You bod better take your own measure, for I sow you with public Uriel' iho other day;" Mr. Wilson was very much oxcitcd ond said they were waiting to get hold of a man Iiko him (defendant) to mako him sweat for it; I can't soy wheibcr Mr. Wilson said, "Thoy" or "Wo;" Mr.

Wilson went on to say about this man there was no namo mentined that he was innocent; there was a remark mado about a person being tried and locked up; a short tinio afterwards, Mr. Cheshire camo to mo and askod me what tbo conversation was; I did not state to him ot that time what tho conversation was; I am confidont that the name of Mr. Cheshire was not used at all in tho conversation; when Mr. Wilson spoko of Martin, I Bupposed ho meant Marlin Kalbfleisc'i who had just been defeated for Mayor at tho tlmo; I did not know at the timo who Mr. Wooley meant by tho term "public thief;" I cant't say'lhat I heard anything said about auy person's beluga "'public robber;" havo known Mr.

Cheshire for some years; knovtbo Provost Marshal's office on Grand stroot; knew almost all connected with it; was in tho office often; knew Mr. ChCBhire'Bbusinecs in the office; he was engaged in paying the recruits bounty money; prior to this conversation spoken of I did not hear ouy statements about tho conviction of Mr. Cheshire. John Nicholson, sworn Am a policeman; havo been four ysars and seven months; am acquainted with tho parties to this suit; know Mr. Cheshire for tho last nine years; was present at the convoisat'on spoken ot between Mr.

Woolley and Mr. Wilson; Wllcou made the remark that he was going to measure "Martin;" Mr. Wooley bad bettor measure your soli', ou were seen out riding with a public said I thought Mr. Cheshire was a persecuted man, and Mr. Wooley eaid that it was a great pity that an innocont niun Bhould be persecuted, but that Mr.

Cheshire had beon tried and couvioled before a Court Martial; there was something said about hia trial bolng for something in connection with tho Provost Marshal's office; Mr. Wooley Baid that he hosed what ho said upon what ho had read in the newspaper; he said ho read thot Mr. Cheshire hod been arroatod tor recoiviug money, whilo Commissioner in tho Provost MarBhol's office; when Mr. Wilson said that Mr was just the man they wanted to get bold o.c; Mr. Wooley replied, "Its mouey you want, Mr.

Wilson caid that ho knew that the Provost Marshal's ofilce wasrotton; Mr. Wooley did not use Mr. namo iu any part of the conversation, to my recollotion; I was the first oue who mentioned Mr. Cheshire's name; when Mr. Wool ley mentioned a "public thief," I did not know whom ho meant, butpresumcd that It was Mr.

Cheshire, Cross examined When I montionod Mr. Cheshire's name. Mr. did not say that ho did mean Mr. Cheshire; Mr.

Dixou was present whon Mr. Cheshire's name was mentioned. Counsel for defence hero proposed to put in ovldonco tho charges and specifications and finllnga before tho Court Martial in Washington on tho trial of Mr. Cheshire. Counsel for complainant said he would be willing lo admit theBo papers iu testimony if the ontlro proceedings would bo put in evidenco thoy would admit tho whole concern, but objected to a portion of tho rocord being put in evidenco.

The Court ruled that it was competent to show the charges and findings of tho Court without tho testimony. The Counsel for defenco then read tho specifications of the charges, accusing Cheshire of having received a pinno and certain sums of money from ouo Nathans, and ono Ilorko, and othors, lor allowing them special priiilegesin tho office of tho Provost Marshal; with having appropriated to his ownuso largo sumsof money belonging to Kings to bo paid as bond money, aud having accepted bribes for transferring a number of recruits to tho credit of Kings with having received biibes from George Sittorly and others, and with having taken $300 from an arrested dosortor, and appropriated it to his own uso, and tho finding of tiio coui thot ho had received niohoyfrom Nathans, Sittorly and othors, for bis lntluonce to help their busiuoss as a member of tho Board of Enrollinont. Counsel then claimed that if they could provo that Mr. Cheshire had beon guilty of using this procoss of mulcting peoplo for allowing them to transact thoir ripbtlul bupiiiess in the office to which ho was connected, ii found a fraud upon tho govornmout and people of tho UniieU Slotee. Cr.ooko for the complainant, contended tho making of a to a public officer and tho acceptance ol Ibe same, did not constitute tho rocipiout a thief. It is of history that thoro is but oue public official in hiflh position who refused to aocopt a present, It was a common custom ond was participated inby'pubhc officials overywhoro. Tho only ovldonco on which Mr. ChcBhiro was convicted was that of pur jnred witnesses that ho had rooelvod presents irom bia subordinates. The further consideration of this point was resorved.

Milton Wooley, sworn Am defendant in this action; recollect the conversation referred to by tho witnesses; I was standing at my store door, when Mr, Wilson op proathed wilh a tana, lino in his hand and said, "I'm goiug to measure Martin for a coffin, as ho is laid out." I said you had bettor measure yourself, as you wero seen waiting with a public thief." Ho said that man is as innocent as you ore, and you may be called on to to prove this. 1 said it don't need much proof, as hB baB been convicted. Mr. Wilson then said that Che nhire as convicted only by the perjury of Nathaus and Silterly to clear themselves. I said it was a shanio that afiy man should bo sworn against only to clear anv one; I said I should judge from the men who had tried him that thoy must have somo moro tangible evidenco than that to send him to the Penitentiary; be said "he was not tried for stealing ho was tried for receiving I replied that I did not think any Court would send a man to the Penitential lor merely receiving presents; I told him, from what I Raw in the papers, that ho bad boen tried for falsely appropriating money, or the people's money; I remarked that I did not think there was any harm in stealing in theso days of publio cor ruption, so long as a man did not get caught at it; Wilson said you, you mean' me, and I wid smash your snout for it;" I Bald I did not; ho said you, you do, and I will have you punished for it," and then went off; I knew of tho arrest of Cheshire at the time of bis arrest; at tho time I made the remark, I did not intend to make allusion to Cheshire; I had not sson Mr.

WilBon riding with Cheshire; I am confidont that I did not use Mr. Cheshire's name in the whole conversation. Cress examined. When I said that a nian who had been sentenced to the Penitentiary must have bean guilty of something, I meant Cheshire, as Mr. Wilson had introduced bis name.

When Wilson said that I shcnld not tall ibat way about Mr. Cheshire, I did not say that it was not Mr. Cheshire that I meant.
