Tn the matter of the Habeas Corpus in behalf of Jolni Ihinn.k Habeas Corpus was issued in the above iratter by Judge Belts of ihe United States l)is rict Court, returnable this morning. It appears said D.ion ia a minor under the age of 21 years and enlisted without tbe consent of bis parents in the 158ih Regiment New Voik Volunteeis, in tbe month of July, 1S62, and went to the ceat of war, was there for nine months, and came borne, and was arrested as a deserter by Provost Marshal Gregory. The writ was served on General Caaby who meue the following return First. That said Dunn enlisted in tho 15Sth Eegimeni ew ork volunteers, and madeoaih that he was 'J 1 years of age, and received $7f as bounty from the United Slates. Second.

That he Dunn has been arn sfed for desertion by the Provost Marsha' aud has been committal in full for trial by a I'nited St tes Courtmarshal and placed in the custody of Lieutenant John Macy on Governor's Island. Third, That said Dunn deserted in the month of May, 1S6S, while his regiment was ia actual service, in ttie lace ot the enemy. Thomas E. Pearsall, Counsel for petitioner, traversed the return, denying hat said Dunn deserted in the face ofthe enemy or received $75, as bounty, or made catb that he was 21 years of age.
