The fact that the plaintiff oon tinned to cohabit with his wife, after her alleged communication to him of the charge, and up to July, 1874, is cogent evi deDCO against the truth of the present charge.

Several cases are cited in support of that proposition, and in actions of divorce on account of adultery where the wife Is a plaintiff or defendant in questions between tho husband and wife, that proposition is oovered; it la a sound rule. The faot that a plaintiff who la afterward the plaintiff in an action seeking a divoroe oontinued to cohabit with his wife after or long after her guilt had been communicated to him, is a proper matter, peculiar to such an action, because In that action the husband may bo charged with having oondened hia wife's offense, and because, also, tho man who finally cornea into Court seeking a divorce, is the same man whoso conduct, after living with hie wife after hia knowledge of her guilt, Involves an Incongruity. The same spirit that leads him to prove his action for a divoroe, would lead him to a separation from his wife as soon aa be learned her guilt. But in this action it doss not apply; I do not think it is of any moment whatever. it VT.TTTT Tho ntianpj, nf the nlaintiff toward the de A.

Tbe Flftletn Anniversary of a Venerable Prelate Honor to one of Ireland's Noblest Prelates. DtrBUH, June The readers of the Eaolk have doubtless been Informed in a general way, by telegraph, of tho celebration that took plaoe here yesterday over the fiftieth anniversary of the Episcopate of Archbishop McHale, but I assume that all your readers who can go back in memory to the fine old City of Dublin and tho noble life that has now for half a oentury provaded its religious society, will be pleased to have a detailed ao count of the proceedings. ArchblBhop McHale has for so many years occupied a oonsplouous position ln his churoh and his country, and borne so distinguished a part ln the history of both, that lt Is not surprising that the clergy and people who have so highly appreciated his ability and esteemed his charaoter should celebrate as a Jubilee the fiftieth anniversary of his episcopate, and make" lt an occasion of special honor.

The general feeling of his friends found expression yesterday ln a remarkable demonstration representing different classes of people with whom his Grsee is connected by personal, offlmal and political ties. It was a spontaneous and cordial tribute to reverence and affectfon which oould not fail to make a deep Impression upon a sensitive and grateful heart, though lt reflected almost exclusively the sentiments of the province over whioh he presides, and cannot properly be considered national. It is true that the Irish members of Parliament sent a deputation to present an address, and the Home Bnle League was similarly represented, but there was. nothing like a concurrent movement throughout the oountry to take part ln the "golden wedding" as the anniversary is called In some of the journals. It waa also noticed aa a significant fact that only one Bishop in the Archdiocese, Dr.

To the Editor nf the JSrooWjm Eagle Pardon me for enoroaching on your time and spaoo, but I would really uko to ask you question in a publio manner, no tbat if you oannot answer it perhaps someone else oan.

My question ia this, how long must a porson attend a prayer meotlng beforo the pastor or tho member) of the ohuroh with which tho prayer meeting la oonuootod will recognize him by some encouraging word, or a warm grasp of the hand that aays, "Welcome to our Tankst" I ask the question so that if there Is any established custom or definite time to govern such matters, I would truly like to know it, for it would enable mo to determine a vexed question. My wife aud I havo attended a certain prayer meeting on the Hill regularly for nearly a year, and durlna aU that time not a soul has exchanged a word with either of us, and we are yet breathing tho lame frigid atmosphere every time we enter the room that we partook of the first tlmo we sought the mooting. Wo listen Intontly to the good minister and the good gentlemen as they pray fervently that the time will dawn when all men will love tholr neighbors as themselves, and that all who aro without tho fold may be brought within, and that those who are within may extend the right hand of fellowship to those who still stray away from the house of God and assist them ln becoming Christians, but we fall to see any practical demonstration of the rsllglon they preach'; we fail to sec a manifestation of tho Christian love they talk so much about, or even friendship, and we fail to feel tho warm grasp of the hand and to hoar the encouraging words, "You are welcome, come again." But all is cold resorve, no warmth, no light. Aro all prayer meetings llko this onof If so, surely the elect aro there, aud none without can enter ln. I am told that a porson cannot attend a prayer meeting over which Dr.

Duryea presides but three or four times, before he seeks him or her out and greets the new corner in a spirit of brotherly love, ahd the olrole la at once opened by the members of the meeting and yon ara made to feel at ease. This 1b said to be the secret of tha Doctor's groat popularity. I would that this community could boast of many moro auch men as Dr. Duryea. You find no shallow aristocracy there, whose MgltiU oharmod circio yon cannot enter, but you find trtw nobility of tho soul, and those who believe In a praotloal religion.

I am Indisposed to speak of the evidenoe of what you may draw or not draw as being oogent. You will oonsider and satisfy yourselves as to the motives which led the plain tiff to first disclose the fact to Mr. Bowen, If he did do bo led him to remain In association with his wife led him to renew the friendly intercourse with the defendant, and led mm to whatever characterized his conduot and oourse In Wlferel'on a material question of faot, the plaintiff swears one way and the defendant dlreotly adverse, and the defendant puts in evidenoe a written statement made by the plaintiff before the action waB commenced (no matter whether it was before tho action waa commenced or not), and flatly contradicting his testimony; the jury are bound to consider hia testimony on the point as conclusively Well, that is true as properly applied. If A brings an action against on a claim resting in parole, a claim for work and labor, or money lent, and now being allowed to be a witness, testifies onlthe trial to tho faot that the defendant was indebted, and denies that he has been paid, and the defendant produces a letter written by him stating that the claim had been settled and paid, that would be oonoluslve of course in connection with defendant's denial. The Jury ntmt settle the dispute between the witnesses. Aa to the letters in general, if they did not refer to a special cause, they must receive ordinary oon etruotiou. As to the alleged oonfeBslons, the Jury must bear In mind that memory of words used waa likely to be of tho inflrmest kind. Bvldenoe of confessions oould be made of wrong import by the Introduction or OJuesion of a single word. The Oourt would let Jo Blohards and Kate Carey Smith go to the Jury wlt' oat notice.

The question of questions was Mr. Beeoher charged with adultery? If he was charged with adultery and knew that ho was charged, then his conduot at the reooption of the oharge and since oould be explained simply. If Mr. Bee jher on the other hand had been charged with the leaser offenses, and if he had been asBUred that the eon sequences charged had followed, then the Jury oould interpret the evidence In that light. Mr.

Neilson then gave a long and not unskilful sketch of what Mr. Beecher had said ho thought he had done. Mr. Field feels confident that the motion to rodnoe the bail will pspvall, and that Tweed vrill then ba able to furnish it and be released. If the motion to quash the criminal indictments does not prevail, tbe defense will try to postpone the first trial until November, as Mr.

David Dudley Field la desirous of spending the Summer in Europe, It will be observed that the grounds of counsel's aotion ln all these matters are purely technical; but technicalities are the important part of the law nowadays, and If Mr. Tweed oan esoape by them, he will not trouble himself about puhllo opinion as to the facts alleged ln the indictment. Waiting for tbe Verdict. Tilton and his counsel left the court room shortly after the Jury retired. Mr. Beecher and his immediate personal friends remained. The old niari bore every evidence of perfect mental sevrenity.

He had a lunch provided for sandwich, an orange or two, and his favorite fruit, the succulent banana, and he munched and walked' about and laughed and talked and read from a newspaper, and seemed anything but a defendant in a great ecduction case, waiting for a verdict that was doubtful. One thing was perfectly evident, whatever might be the result, and whatever the world might think of him, the old man's conscience is peaceful. Tilton had a gloomy look about him, as he. italked from the room like a genius of despair. The crowd that remained and sweltered in the court, room was quite a jolly one.

Messrs. Abbott and Shearman remained with Mr. Beecher, and Mr. Evarta came in at half past two. There evidently existed an impression that the jory would come in with a verdict before long, although no one seemed to have any substantial basis of fact to found the opinion on.

It remarked that no sooner had the Government system of national eduoatlon been proposed than, "with the keen glance of genius, he detected the dangers of religion hidden under those insidious favors." The Society of St.

The clergy of the archdiocese recognized In Dr. McHale "the illustrious suocessor of tne great St. Jar lath, of that long lino of distinguished Prelates who had presided over the archiepisoopal see of Tuam, and further, as the unerring defender of Ireland's faith and Ireland's national rights." If at all, Mr. Moul ton's previous contradictory statements oould be and an honorable purpose to suppress the scandal and protect the defendant and protect Elizabeth, and the same suggestion applies to Mr. Tilton. No man can talk ten days and hold always the attention of his readers or hia hearers, but Mr. Beach has bored both as little as oan be expeoted of any advocate in a speech of euoh dimensions. It may fairly be donbted, though, whether speeches of ten days in length do not defeat their own objeote. The continuous attention whioh they demand oan only bo expected of students, which the average juror Is not, and the tax upon the attention in the jury box becomes a far more severe tax upon the memory ln tbe Jury room, where tne salient points of an argument are almost lost in a oloud of forgotten detail. It stems that lt would be better to present the salient points alone than to run this risk, and that lt is a greater risk than the risk which advocates take bo much pains to avoid, the risk that the Jury may think they have shirked the pointa they have passed.
