Eaggot was convicted at the last term of the Court and was sentenced to 10 years imprisonment in the State Prison. On the trial of Baggot it was shown that this prieoner struck Feeny, but no evidence was produced to show that he took the money or anv portion of it. Mr. Spencer, who appeared as counsel for the accused, asked tbe in consideration of these facts to accept a plea of assault and battery, urging as a reason for so doing the respectability of the prisoner's friends. The Court refused to accept iho plea, but stated that a plea of attempt to commit the crime charged would be entertained, which suegestion the prisoner's counsel agreed lo.

The prisoner was then rpmonded to jail, and will be brought up for sentence on John Kvans, a boy about IT years old. was "arraigned on a charge of burgltry and pleaded guilty to petit larceny.
