It will be remembered tbat on that occasion tlie prisoner now on trial made a very plausible statement before this justice hi which ho appoared as the innocent tool of a man named Perez, in the transaction. It pubse quently appeared to the Justice, however, that Delphos was, in reality, the principal criminal himself and Peres the tcoh Perez was brought up for trial yeaterdav, when ho pleaded guilty, and was remanded for sentence. This morning Perez was used by Mr. Thomas Peareall, Assistant Disinct Attorney, as a witness for the prosecution.

The plaintiff iu this case is a property holder on Franklin avenue. It will be remembered that some few weeks back he procured an injunction, restraining the defendants from laying their tracks on tho proposed line along Second street, E. Wytho avenue, and Franklin avenue to tho city line, and thonco by Clove ruad lo FlatbuBh. Tho injunction was granted on affidavits setting forth that the Railway Company had not complied with the requirement of their charter, which prohibited them from commencing their work until they had obtained the coupcnt oi thu majority of the property owners along the line. Last week an effort was mado by the defendants to havo the injunction removed, and a hearing wasgvauted for thu purpose of them produce testimony to show that thoy had really complied with their charter.

To this end thoy brought up the partic whom they had employed to collect signatures, and had them examined. Their case was managed by Henry C. Murphy, while H. C. Piacc, oi" tho firm of Troy Place, appeared for the plaintiff.

The testimony elicited by the direct and crosT examinations went to establish the fact that an attempt to obtain tho consent of the property ownen; had been made before the construction of tho road was begun. But it also apjearcd that this had been done in a very imperfect and unsatisfactory manner. In the Iirst place the names of the supposed property holders were obtained from the books of the Tax Office, which aro rendered notoriously unreliable in thut respect by the prevailing neglect of purchasers of real estate to hand in their names as owners to tlie Thou again tbe fact was elicited that the name of many owners id been obtained after the commencement of the work, and even since the issuing of tho injunction, and if these were rejected by the Court ihey would reduct: the number below the mujority claimed by the defendants.
