Pursuant to ailjournniont, the Court of O.ver and Tormincr was opened at half past nino o'clock this morning, for the purpose of hearing argument of counsel in favor of having the trial of William Chambers postponed until next month. Mr. Charles S.

Spencer and Xfr, William F. Howe, associate counsel for tho defense, were on hand at an early hour, and long before the timo sot for tlio opening of the Court a largo crowd had gathered in tho vicinity of tho Court House. In conversation with members of tho bar, Mr. Spencer said it vfould be impossible for him to get ready before April, and slated that ho thought it would not be just towards the prisoner to force them to go to trial bef ore that lime. When the case was called Mr.

Howe asked for a postponement until the third Monday or Wednesday iu April, on account of tho difficulty in proparing for the defense, which was rendered more difficult on account of tho intense excitement which had been caused by the event. Mr. Howe also read au affidavit drawn up by Mr. Charles S. Spencer, ono of tho counsel for the defense, setting forth that from conversations hold with tho prisoner ho had not yet been able to get at the truo facts of the case; that he had been informed that prisoner's mother had died in a lunatic asylum, and that Chambors had bceu born while his mother was iu tho asylum.

To establish thoso facts it would bo necessary to send a Commissioner to Ireland, and the dokvy was also asked for on account of tho lime which would be required lo get. important witnesses from Washington. Tho theory of tho dofenso was to be that of insanity. His Honor Judge Gilbert, remarked that tho affidavit did not present any logal objections, aE all the allegations contained in it were only on information and belief. Mr.

nowe stated that the iuformaliou that Chambers had been born in a Lunatic Asylnm was given by Chambers himself. Mr. Sponccr then addressed tho court at some leuglh in support of his application for a postponement. He should prefer io havo it put down for Wed nesday instead of Monday, as that would give him more lime to devote to tho dofonso of McFarland, whoso trial was set down for the first Monday in April.

Tho information that Chambers had boen born in a Lunatic Asylum, was extracted from the unfortunate man himself, whose mind was now in such a state that he was almost wholly unlit to bo placed on trial. The lecturer gave a comical narration of a night's experience at Grey town while awaiting a steamer, which came on the following day and ho proceeded on hia journey. In the magnificent harbor of San Francisco the combined navies of tho world could Bafely rido at anchor, while in the city, which, only tsventy years otto was a rude place, everything bad changed, and it was now a fine city with over 100,000 inhabitants, and flue streets and buildings. The stores and hotels were equal to those of New York and Brooklyn, and tho markets superior, Tho only Bcarco thing was water, which was very dour, and there was no rain from May 1st to November 1st. Thoro were no atormi, nor thundor and lightning, hut there were earthquakes.

California was a country of big things big babies, big fruit, big vegetables and big trees. The blindness of Ihe orator, and his remarkable power of word painting, and genuine declamatory abilities are mutters of record nor, wo believe, is the present lecture unfamiliar to Brooklyn Nevertheless, its repetition deserved a wanner welcome and a fuller house. Mr. Curtis, tho night before, at the Unitarian Church, corner of Clinton and streets, lectured on "Thackeray," to barely a larger audience than Mr. Milburu's of last evening.

Ilscems demonstrated that lecturing is at a discount iu Brooklyn, and that the better the discourso the smaller the attendance. Mr. Milburu's subject is simply a very graphic and interesting narrative of a walk through the capital of tho world, and a full report of what matinor of persons, associations, institutions, ajd peculiarities it reveals. It is a real picture of Parisian lifo, told with fidelity, elaboration and. humor, the suggestions, lessons and import of the scenes being covered with a truly American comment of common sense and Western world humor.

We have not in a long time heard a gentleman who succeeds iu throwiug himself into his subject more unreservedly and who keeps his personality so modestly behind his topic. The pleasant conviction, too, possesses tho audienco that he is an observor of raro accuracy, aud a gentleman, who would to pese for a moment upon their vrntravelcd impressions. Mr. Milburn's nutural gifts of oratory ave very considerable. Hchas an irresistible mimetic power, never exaggerated, and always iu control, a capacity for the description of the relation of things as vjcll as of the tilings themselves which is very extensive, and a genuine hatted of cant aud love of order, conservatism aud justice, which were as much a surprise to hear from Plymouth Pulpit as they were gratifying to hear at nil.

For reasons which are obvious we decline tvportiug the address. What is at best private property is doubly sacred in the case of a gentlemen who hr.3 attained hii accomplishments through so much more labor than fall to the lot of those of us to whom God has not denied sight. No penalty is specifically provided for the violation of this clauso; but a breach of an express provision of tho law creating the title to the ofiico, may fairly be construed to involve the penalty of forfeiture of the seat, when proven upon any in e.mber. It is certain that, if Mr. 'Whiting, tho stationer, be tho same gentleman who is, an Aldcrmun, and it' he has received money from the city treasury through Ihe Board of Education, as a contractor fur supplies to the he has clearly broken the charter commandment, and his colleagues, ou proof of the facts, would be entitled to declare bis seat vacant. The importance of the charter clause, if only we could have it fully carried out, would bo immense. If we could cut off from city expenses every pcrsoual interest of officials to pay two dull irs for one dollar of supplies, wo would savo at a stroke three quarters of all the superfluous expenditure.

If public ofiicials ever spend too much money, it must be where they havo a diroct or indirect personal interest in doing bo. The natural ambition of each would bo to earn by economy tho confidence of tho public; and whore a contrary course prevails, immediate selfish motives will usually be tissumcd to have prevailed over the remote motive of ambition to earn a good name before tho people. But almost invariably dishonest selfish motives will be concealed under the surface. A man that wanted, while buyiug for the city with ono hand, to sell to it with tho other, aud thus iix his own limit of over charge or short weight, would be too cautious to sell in his own name. He would cover bis tracks by a mb rosa understanding with another man acting as nominal contractor.

We therefore have" no hesitation ia Baying that tho very opeuness aud notoriety of Mr. Whiting's ccntract for supplying the public Bchools with stationery, vindicate him from suspicion of having broken the spirit of tho section of the charter, though he probably inadvertonlly violated its letter. If it were shown that without a contract, by some indirection or jobbery, Mr. Whiting was secretly supplying tho stationery, his conduct would appear such as not only io justify but to demand, tho full enforcement of the penalty attaching the breach of tho charter. But con sidering that ho openly compoted lor tho contract, aud won it by being tho lowest bidder, and from a department over which he has only a remote aud indirect voice, namely a vote in confirmation of School Trustees wo cannot doubt that Mr.

Whiting is iu this matter morally innocent, though it would seem impossible to doubt (hat he has technically violalod the organic law of the city of which he is an alderman. ONE GLASS OF WINE.
