Judge Lott charged the Jury in this caso yesterday, to the effect that no agreement between the owners and tho company, by which the former could recover the loss of their vessel, had been proven and the only question they had to determine was, how long this vessel was cruising, or how long she was In the servic or employment oftho defendants.

It appears that in 1851 Mr. Corn well was. tho proprietor of tho stage route betwoen Flushing aud Now York, and had tho contract for the carriage of tho mail. At that time ho sold out to defendant, who undertook to comply with the terms ofthe contract then existing botween Cornwoll, (plaintiff) and tho Post Office, and to pay him $80, aod to satisfy tho balance of the purchase money, nearly $660 in all in carrying and delivering till Juno 1853, tho mails. That tho defendant failed in carrying the mails after three months, and the plaintiff had to do so himself.

That in preparing to do so he was put to $200 expense, and besides that defendant becamo liable to pay the balance of tho purchase money. The defendant in his answer admits the contract which was entered into by plaintiff and defendant in this caso and ono Amasa Rockwell, Jr. Thoy began to carry tho mail us por agreement, and defendant subsequently bought out Rockwell's interest in the route and continued tho business himself until interrupted by the plaintiff, who, without anv default on defeo dam's part, and in violation of the terms of agreement tuo planum re estaoiisneu a lino of stages on tho said route and resumed the carrying of said mails to tho damage of defendant who had gone to groat expense in establishing his lino of stages. The United States steam sloop of war Wabash, camo in collision with, the United States xazee Savannah about half past 8 o'clock ibis morning, while being taken out of the Dock at the Navy Yard. The quarter boat and Captain's gig of the Wabash weie cruehed causing damage to the amount of about $1,000.

A beat on the Savannah was also somewhat damaged. The accident occurred in cor sequence of the bungling manner in which the Wabash was hauled out. We are not advis ed whether the accident will delay her departure for the gulf, where she is ordered to cruiso for the protection of American Commerce. Vitrified Watik Pipe. The Commsssioners of Sewerage and Drainage have advertised for proposals to furnish a quantity of vitrified earth en pipe to bs used as drain pipes throughout the city, but it is said the work will bo necessa rily delayed for a long time in consequence of the fact that there is no manufactory of sufficient extent in this country to furnish the quantity required in time for use.

The largest manufac tory, which is in New York City, can only fur nish two thousand feet a month, while tho Com missioners will require, immediately, some ten or fifteen miles. The probability is therefore that the order will be sent to Europe, if some of own manufactories do not exert themselves, there will be a large demand it would be an object for some enterprising manufacturer in this country lo make some inquiry in relation to the matter.
