The case of Oharlos Myers, a private in the United States Army, arrested for desertion, and dl. charged on a wilt of habeas corpus by Judge Troy, on pica of his having been enlisted under age without the coneint of bis parents, a fall report of which was published last week oxolusiraly in the Eaqlh, was broughl ap again tbis morning before Judgo Troy, tn accordance with tho terms of the adjournment. F. Tracy, United States' Dlstriot Altornej opened on behalf of the government and Thomas E. Peareall appeared for tho prisoner, Mr. Myorp, Mr. Tracy, when the caso was callrd on, stated that be had been requested to attend to tbls matter, but hla notico had been so short that ho would be constrained to ak the 'court for a further delay to enable him to mate a full investigation.

There wore several Vory important points of law Involved, and he did not want to bo hasty in the matter, as it was exceedingly desirable that these points should have a final settlement. Since the case has been called on in the court last wook. General Vogdes had written to hla superior officer ana laid the facts of tbo case before him, and asked for In etructions as to what course he would pursue, as ho (Gen. intended that tho responsibility, whatever It might be, should rest with his superior officer. Th re arrest of this party was made, as hod been previously staled, in obedience to an order of the Seorotary of War, and (ho (Mr.

wanted the conrt to postpone tba case until General Vogdos bad some instructions ai to the course of action he should pursue in tho matter. Judge Troy Bald that he was willing and anxtou to give the Government all the. time necessary to bring tbo matter to a satisfactory conclusion. The case, aa bad been remarked by Dlstriot Attorney Traoy, was one of great importanco, not only to tbo peoplo but to the Government, and the settlement of the legal points involved was eminently desirable, so as to prevent any such complications in future. Ho could not see why tbcre should he any conflict between tho United States authorities and the State laws, but the United States officers Ecemcd to labor under the impression, that the judiciary of iho State wero oppoied to them.

Ko far as ho (Judge Troy) wal concerned, ho would continue as had always done fn administering tho law, to respect ths rights of tho United States as much as that of tho humblest citizen of the State. The parties who had arrested this boy alter hiB discharge on a writ of habeas corpus by a competent conrt were guilty of misdemeanor, and he (Judge Troy) considered it bis duty to call the attention ot the Grand Jury to it on Monday next, becausa he was determined to do h(s duty without fear or favor.
