To thorn the chilly winds of autumn are laden with the odor of prospective briefs and fees. They scent tbo battle from afar, and tholr aro already resounding with the din of tho lega conflict which will bo inaugurated on Monday next. The gentlemen who practise this profession in tho Admiralty Courts have boen combining business with pleasuro by studying nautioal matters at the sea ports along tho sboros of the EcBtern States and have como back ready to bother a witness and astonish tbo court with ths extent of their ship building and sailing knowloge.

Others have been rusticating in iho woods and on the mountains, Thoy havo hooked some of the largest trout on record and as a natural consequence expect to pocket fees of fabulous amounts during the coiuiug fall and winter. Others havo flitted around to tho differ, cnt fashionable watering places and all of them aro as brown and sinewey as IndlanB and evidently considerably improved both physically and mentally by their summer vacation. Next Monday Judge Thompson will commence tho trial of Equity cases in the City Court, and on the following Monaay the flrBt twenty casea to be trlod by a jury will be oalled. 6, At Covington, Indiana, on Saturday, Frederick R.im ster was found guilty of murdor in the second degree. The trial lasted four dayp, and on account of tho horri Mo nature of tho crime created considerable inforost. It will be remembered that last June he shot and killed Mrs. Jones, a widow lady, without any causo other than that he alleged Mrs. Jones hid meddled with his domes tio affairs; at the same time ho shot and seriously wounded a beautiful young lady tbo ball lodged in her braiD, and though she still lives she haa become Insane, Since the murder Bcmster has feigned insanity.

Helena and Corlnne lino on tho night of Au gust 3lBt, A party of eight men, masked, rushed out upon the coach, ordered tho driver and tho passengers, ten in number, to keep quiet, and then they took pos session of threo boxes containing 830,000 in gold bricks and dust. They escaped with the plunder. A ITIan Crushed to Death ly a Calling Wall. A laborer named Daniel Lexton, a single man residing with his Bister at No. 116 FirBt street, whilo engaged on Saturday about noon In excavating (he cellar for tbe new public markot about to bo erected on tbe block fronting on First street, between South Sixth street and Broadway, was almost instantly killed by the falling npon him of a portion of the oun dation wall, cauBed by digging out a eand pit directly beneath the line of the wall.

A number of other workmen barely escaped the falling debris by getting out of harm's way at the first indication of danger. The companions of tho unfortunate man lent every assistance to extricate him, from, flts per situation, but it was not until life was extinct that the mass covering his body oould bo sufficiently ro moved for the purpose. Deceased was about 40 years of ago and leaves no other known relative except tho sister mentioned. Coroner Whitehill empannelled a jury, end as a preliminary to the inquest to be held this owning, visited the spot yesterday to obtain a cor rect idea of the cause of tho catastrophe. The Fibe Depabtment Examination op Dmvebs.

A large number of applicants for appoint ments in the Fire Department appeared at headquarters this morning; only tho engine drivers howevor were considered. A tborobgh examination, medical and otherwise, was made of each candidate; and before appointment, a practical text of the capabilities of each will be required. The salary attached to the position of engine driver is 8000 a yoar. Dr. W.

F. Swalm, who conducted the Burgical part of the examination, is a yousg man who was previously nnknown to the Fire Commissioners, and was highly recommended for the important office he holds by many of the eminent surgeons and phyeicfans of tbe city. During tho war, ho went out as A6Bi6Unt surgeon to the Brooklyn 14th Eeglment, was afierwards appointed Surgcon ln Chief of the General Hos pital at Wneeliug, and subsequently joinod the 15th N. Y. Engineers, remaining with Ihom to tho closo of the war.

Ho is an old hand at tho work now required of.bim. Fatal and Minob Casualties. A child, named John Feeney, aged threo years, whose parents lvo in Taylor street, E. was fatally injured on Saturday afternoon by being run over by a truck iu Kent avenue. Mrs.

Mary Daley, an elderly woman received injur ies by a fall down the Btairs of her residence at No. B2 North Sixth streot, which rosulted in death a few houre subsequently. John Duplin, a carlruari, whilo driving along Broadway on Saturday evoning, was thrown to th9 pavement, and besiflOB being bruisod by iho fall was otherwiso injured by being run ovor, but not seriously. To complete the llBt for Saturday, a child, named Lizzie Maurer, fell from tho third story window of a house at No. 90 Ewen street, the residence of her parents, to the sidewalk, and escaped with a few slight bruises.

The case of Street Commissioner Farey against Charles Kelsey, tho well known and extensive ownor of real estate In Soath Brooklyn, and his son, was called by Justice Walsh at the police oourt, at oloven o'clock this forenoon. From the full re port in tho laBt issue of the Eaq, of the origin of the trouble, it will be remembered that Mr. Furcy, with a potse of officers from the Forty third Precinct, proceeded to the foot of Irving street, Saturday forenoon, and ordered a cessation of work upon certain warehouses there in course of erection by Mr.

KclEcy, in alleged violation of tho City Ordinances by reason of their encroaching upon the publlo streets, when the younger Mr. Kelsey, it is alleged, committed an assault upon Mr. Furoy, by taking him by tho collar and resisting him in the discharge of bis duty, in consequence of which, the father and son were arraigned befere Police Justice Walsh on the same day, and admitted to bail for further appearance to answer the respective charges of violation of the Oity Ordinances by obstructing the public streets, and committing an assault upon Street Commissioner Furoy, resisting him in the dlschargo of his offloial duties. Upon the calling of the case for assault, Mr. Kelsey, Jr.

waived an examination and waa admitted to bail to await the action of the Grand Jury. The ease for alleged violation of the City Ordinances waB then proceeded with as follows, ev Judge Emmett. of New York, and ex Justice Blatohley, of Brooklyn, appearing for the defence, and Assistant Corporation Attorney Johnson, for the proseoutlon: Formal answer, in writing, was offered by ex Judge Emmett, on behalf of the defence, denying the allega tionof tho complaint; claiming ownership of the street on which the alleged illegal encroaohntent has been made, and requesting a removal of the oase to the Su preme Court, It was claimed by tho defence that Justice Walsh had no Jurisdiction in the matter of proving title, and that being tho main question involved necessarily removed the cbbo to a higher Court, The Assistant Corporation Counsel opposed the motion and claimed Jurisdiction of the Police Court.
