Steinfeld, attorney for the certificate holders, who number more than 200, charged ln the complaint that his clients were the victims of a triple switch by Julius Lehrenkrauss, former president of J. Lehrenkrauss and Son, who now is serving term ln Sing Sing for grand larceny. Lehrenkrauss, he charged, sold certificates on mortgages held by J. Lehrenkrauss and Son, giving more than 200 per ions of minor means an interest in the mortgage in exchange a total of $263,000, made up of their life savings lrj many cases. After selling the certificate Steinfeld charged, the elder Lehrenkrauss transferred the mortgages on which the certificates were issued to three employes of the firm, who act- ed as dummies.

The three employes, Henry Steub-ing, Walter Dente and Lorin Oster-hout, then transferred the mortgage to the Lehrenkrauss Mortgage and Title Guarantee Company, one of the several corporations owned bjl the Lehrenkrauss family. All this, Steinfeld charged, was without the payment of any money, except that which Lehrenkrauss collected in the sale of the certificates. 'Couldn't Collect' When the mortgage company was seized by the State Department of Insurance for liquidation In 1934, the holders of the certificates thus were prevented from collecting on their investments, according to Superintendent Pink, fighting the unit through his counsel, Alfred Lusthaus, contended in his answer that the mortgage company paid the three employes for the mortgages, and hence was legitimately entitled to sp whatever money can be raised on the remaining assets by liquid tion.
