1943 73 REAL ESTATE BROOKLYN EAGLE, SUNDAY, FEB. Owners Protected By Planning Body Chairman of Realty Board Committee Sees Benefits in Residential Areas 3 8' 5 11 1 f- Property owners should feel relieved that the City Planning Commission has refused to approve a change in the zoning resolution under the terms of which the door might have been opened for the erection of industrial buildings in A. 1 1 "WIHHHIiiUMiM Umnm 'llrlflimt in twr i tiiAitj wLuixi une or me recently completed residential neighborhoods, Frank Brooklyn Real Estate Board's Com mittee on Municipal Government and Ordinances, said yesterday. The proposed amendment was the subject of a public hearing before the City Planning Commission on Thursday, at which Mr. Barrera opposed the change. 'The provisions of Section 21-C of the Zoning Ordinance are restricted to large-scale residential developments, while the proposed amendment, which fortunately was voted down, would have eliminated the words 'residential' and dwellings' and thus have changed the intent of this particular sect. in anci opened it up to include all types of developments," Mr.

Barrera declared. "Under the existing zoning regulations the respoasibility for making major zoning changes is lodged in the Board of Estimate, which is an elected body. The proposed change would have part of thus power to the Board of Standards and Appeals which, upon the approval of the City Planning Commission, would have had the right to grant variances from use, height and area restrictions in all types of developments exceeding approximately one-half block in area. "While it is doubtful that either the Board of Standards and Appeals or the City Planning Commission would have abused this power, the fact remains that major changes In building requirements should go to the Board of Estimate for final determination. "For the defeat of the amendment part of the credit should be given to Park Commissioner Robert Moses who was quick to discover and point out the dangers inherent in the proposal.

"Zoning is a serious matter and very careful thought mast be given to all proposal? which would make fundamental changes. The right) of property owners, particularly when they involve homes, must be protected if we are to preserve real estate values in this city. "It is also gratifying to record that the City Planning Commission was very careful to grant full and complete hearings on the proposed amendment before taking action. Questions like this must and should be discussed openly and fully."
