BROOKLYN EAGLE, JUNE 26, 1953 9 SEN. WILLIS SMITH, 65, DIES, N. CAROLINA DEMOCRAT Washington June 26 (U.P.) Senator Willis Smith, 65-yearold North Carolina Democrat, died early today after fighting vainly to overcome the effects of a heart attack. He was pronounced dead at Bethesda Naval Hospital while his wife and four children stood at his bedside. The cause was listed as coronary thrombosis.

Smith, who ran for the Senate an afterthought and won in 1950, suffered a heart attack Tuesday and was taken to the naval hospital in "grave" condition. Physicians said yesterday his "pulse and blood pressure" had improved and that he was "manifesting miraculous strength," but he never rallied. Smith sought the Democratic nomination in North Carolina's first 1950 primary against three opponents, Senator Frank Graham, former Senator Robert Reynolds and Olla Ray Boyd, a perennial candidate. Smith ran a poor second against Graham, but under the law a runoff primary for the nomination was necessary if Smith, in second place, chose to demand it. Apparently he considered his chances poor against the popuGraham, but at the last moment, Smith asked for a second chance.

Smith won the runoff easily on June 25. During his Senate service Smith voted usually with the conservative Southern Democrats. He was a member of the Judiciary Committee and of the Senate Internal Security Subcommittee. COP SET FREE IN FATAL TRAFFIC ROW SHOOTING Queens police said today they would file no charges against a Nassau probationary patrolman whose gun killed a Great Neck butler last night while they tussled in a traffic argument on Belt Parkway in Laurelton. The slain man was Fred North, 34, who died of bullet wounds in the head and chest as he struggled with off-duty Patrolman Charles B.

Profaci, olive oil distributor of 8863 15th went into Brooklyn Federal Court today and asked that his business properties, seized by the Government for alleged nonpayment of $2,081,562 in income taxes, be continued with himself as manager. Federal Judge Matthew T. Abruzzo heard the plea by Profaci and then postponed his decision to July 18. The receiver for the proper- ties, Jacob S. Sieman, of 80 Broad Manhattan, through his attorney, Harold J.

Sherman, opposed Profaci's motion. Sherman stated that Sieman was a long way from knowing exactly what the assets of Profaci's three companies were, and that Profaci had been "unco-operative" in dealings with the receiver. Operations of the firms had been suspended as a result of Government action. MPs Ask Probe in Hanging Of Sex-Strangler's Neighbor London, June 26. Mathilda Olpin of John's Place, died yesterday her home at the age of 82. was the wife of John E. to whom she was mar62 years ago. Mrs. Olpin, a native of Sweden was brought to this country as a small child and lived in Brooklyn for more 70 years.

She distinctly remembered the Blizzard of '88 often spoke of the deep snow that drifted to the second story window sills of many homes. For years she had taken active interest in the KallAid Society, Besides her husband, she is survived by a son, Edwin a granddaughter, Alice Olpin, and two sisters, Mrs. Ellen Johnson, 92, and Mrs. Minnie Olin, 85. Another sister, Amanda Ryberg, died two years ago at the age of 89.

Mr. Orchard had planned to be a priest of the Roman Catholic Church and spent six years in preparation for it at St. Cyril's College, Chicago, and Mount Carmel College, Niagara Falls, Canada.

Ill health, ever, forced him to abandon a clerical career. In 1914, after leaving Mount Carmel, he became connected with the staff of Benziger Brothers, publishers of Catholic books. After five years with the firm he joined the George Batten Company as copy editor and continued in the work after Barton, company merged with Durstine Osborne in 1928. of Shanghai and Joseph T. of Darien, two brothers, Frank and E. Orchard, and two (sisters, Mrs. Leonard Dillion and Mrs. Howard Norback.

Carmel R. C. Church in Astoria. Previously, for 15 years, had been organist in St. Augustine's Church, Ave.

and Sterling Place. Other churches he had served as organist include Mary Star of the Sea and St. Ann's Church, both in Brooklyn. Born in Brooklyn, Mr. Slavin had spent his entire life in the borough.

In his early years, in connection with his work as an organist, he was interested in dramatics, and directed musical choruses in a number of parishes. He was a member of Loyola Council, Knights of Columbus. His wife, Mrs. Emma Slavin, died in 1929. He is survived by a son, James a lawyer and Federal Court stenographer; two daughters, Mrs.

A. F. Balmain and Genevieve L. Slavin; a brother, Dr. James and seven grandchildren.
