Chief Engineer Rice informed the board that the subway would be entirely completed to Fhubush avenuo within live months and that the whole route to the Long Island Railroad depot would be ready within eleven months.

Fulton street, he said, would bo restored to Its original condition by December 1. Mr. Orr exacted a promise from Mr. Hice that be would personally see that the contractors kept Fulton street clear of obstructions as much as possible. Albert O.

counsel to the commission, then made a statement which has a direct bearing upon tho loop question and which proves conclusively that no time can bo set when the commission which is taking testimony on the subway routes in Brooklyn will finish its labors. Before tho Rapid Transit Commission can advertise for bids on the comprehensive system 'of subways, which includes the loop to connect I he bridges, this commission must first file its report for the approval of the Appellate Division of the Supremo Court. So many property owners have filed protests that Mr. Boardnian said he do-sired to consult with Chairman Orr and his associates as to what attitude counsel should assume at. the hearings.

If he should assume to offer testimony In rebuttal of that produced by tho property owners, he said, it would take months he-fore the proceedings are concluded. In hU opinion, he said, that the best expedient would bo for him to simply content himself with cross examining the witnesses of the properly owners, unless testimony was Introduced which was so obviously false that it was necessary to, introduce expert evidence in contradiction. Chairman Orr. nfter consulting with tho other members of the bourd, told Mr. Boardman that tho commission would loave the matter entirely to his discretion.

Instead of Instituting condemnation proceedings the commission decided to ask the Board of Kstimato to revoke all rights which Ficl Brothers may have lo Georgia avenue. Under tho system of routes already laid out it is proposed to construct a subway through Georgia avenue to connect the Broadway and Eastern parkway extension routes. Piel Brothers have persistently refused to give their consent to this route on the ground that they had 'certain rights to the thoroughfare which would bo interfered with by the building of the subway. Tho Corporation Counsel in nn opinion decides that these rights may bo revoked. Penalty Clause in Subway Contracts.

A rally of tho Brooklyn Christian En deavor Union, preliminary to and. pre naratory of the New York State Convene tion, was held last night in the Central Presbyterian Church, Marcy and Jotter son avenues. There was a' good attend ante, although tho heat was of midsum mer Intensity. Badges for the delegates to the Slate Convention, which takes place on October 9, Hi, 11 and 12, In ths Lafayette Avenue Presbyterian Church, were given out. Great preparations ar being made for the convention, which la expected to be one of the most interest lug in the history of tho State Union Eminent men will make addresses on lull portant themes.

W. It. Hassell, president of the Brook lyn Christian Endeavor Union, presided! over last night's meeting. C. C.

Luckey acted as precentor and the devotional exorcises wore led by the Rev. W. R. Barney, pastor of the Noble Street Presbyterian Church. Mr.

Hassell announced at the closc of tho rally that the largo banner of the Union had been awarded to tho Mount Olivet Presbyterian Church, Society ue.d the small ono to Cuyler Chapel. Two now societies were admitted to membership, the Bedford Avenue and Throop Avenue Presbyterian. Tho speakers of tho evening were ths Rev. John McDowell, of Newark, N. and the Rev.

Dr. S. Parkes Cadman, pas tor of the Central Congregational Church. Both said a number of telling things. Mr.

McDowell's subject was: "The Place of Religion In Modern Life." Ho said that the century without problems was a century without opportunities. Ho declared that tho social, political, industrial, the insurance problem, tho news of which might have reached Brooklyn, and all other modern problems were in the last analysis religious problems. In view ot almost univercnl conditions of unrest it was natural that young men and young women Bhould raise tho question, what place men should give religion. The question was heard everywhere. It was a sad commentary on conditions when it.

was known that there were United States Senators in jail nnd others who ought to be there. Some one had said that when the roll was called some Senators did not kn hether to say "Present" or "Not Guilty." Mr. McDowell said that some men de-dared that religion was only good for that infamy of the race, for old men and oil women, but that it was of no uso for Ihe strong and educated man. "Why," said Mr. McDowell, "moo can no more get away from religion than they can get away from the atmosphere.

In thosa modern days, however, people hava no use for a man who goes to church on Sunday and steals a railroad on Monday, Beware of a man who keeps his religion and Ins business separate. Modern lifd has no place for that kind of religion. There was a plan on foot, to which John Starin and Charles Stewart Smith were the principal parties, to pass a resolution eliminating the elevated loop plan from all further consideration by the commission. But Mr. Metz arrived at the psychological moment and forced the defeat of this plan. In tho most emphatic language he informed tho commission that the elevated loop plan afforded the only logical solution of the problem, and during tho courso of his argumont he gave the Mayor some pointers on the question which mado him cease his talk of the city building and operating the, subway loop If no bidders were secured. Mr.

Meta demonstrated that with any other connection betwoen the bridges, but an elevated loop the traveling public of Brooklyn would be compelled to pay two fares in order to obtain tho advantage of an improvement which was to be placed In operation for their especial benefit. there was not a single member of tho board who undertook to contradict Mr. Metz in his statement. The consideration of the Rice report on the elevated loop and subway plans was the first thing on tho calendar. Chairman Alexander E.

Orr, after tho report had been read, arose and mado a little speech. He said that tho subway loop plan had already been laid out and that a commission appointed by tho court was taking testimony. But Mr. Orr admitted that the counsel to the commission could not venture a prediction when this report would be made to the Appellate Division.

The whole question, he said, was ono of time. In the opinion of counsel, lie said, it would take a long period of time to obtain the necessary consents from abutting property owners for tho elevated loop plan! In view of tho uncertainty, however, ho expressed It as his belief that tho best policy of tho commission to pursue would bo to go on and prepare all the details and formalities of both "Then we will be in a position to determine which plan will be the most feasible for adoption," continued Mr. Orr.
