Music Monday and Thursday evenings from 6 to DELIGHTFUL 10 DAYS OUTINO nv SEPT. 97 and OCT. 11. were untimely, Alexander McKinney, attorney for the Westminster Heights company, applied to the Supreme Court for an order directing the Issuance of a peremptory writ of mandamus compelling the Corporation Counsel to accept and record the deeds.

The motion was denied. The appellate division was then asked to take up the case and Justice Hirschberg this morning handed down a decision reversing the order and granting the motion. The opinion states that it seems unreasonable to Import Into the section under which the offer had been made a limitation which will require of the owner a cession of his land as soon as it has been laid out as a street upon the city map and before It has been decided to open the street, in order to make the cession effective.
