Ed. Le.ch against him. A statement of the caso was today telegraphed by Thaw to newspapers and press associations, calling attention to resolutions which have been introduced in the New York i Assembly by John 11. Golden, demanding that the prosecution be terminated. llevicwing ills two trials, Thaw set forth that of the twenty-six men confined with him in the Tombs in I'M, iliarged with homicide, twenty-three are free today, and other men have escaped from Matteawan without being pursued.

Tho statement concludes as tollows: "1 do not ask for sympathy, but only justice, which should be the inherent right of every man. For the deed committed 1 ask no benevolence. It was done in a moment when sorrow wrecked my home, and when 1 was forced to realize that tho happiness of a lifetime, which after marriage should have been mine, was taken from mo. The deed was committed; my family those near and dear to mo publicly exposed to the closest scrutiny; my n.other plunged into grief, and myseit into a living death, the tortures of which 1 do not wish to relate. "I am now a man, my youth passed: my resources impaired.

My parents' charities have been extensive; 1 myself liavo assisted many In need. The future holds for me an opportunity to bring some peace and happiness to my aged mother, who in these eight year's has known nono and who has spent her declining years in untold sorrow. "My adversary now seeks to place me In Matteawan a living hell to there spend the rest of my life, never again to take my place in my mother's home in her remaining years, and in respectful confidence, I now appeal to the citizens of New York, in the power of their sovereignty to stop the prosecution, and, therefore, ask that all peo-plo who believe that I have suffered years of punishment commensurate with my deed, write the representatives of their own district at Albany before Wednesday to support Mil vote for these resolutions." lwu uuiiKioeis, i' lorence and whom he resided for severai months at East Grinstead, Sussex. When sentence was pronounced Elliott, who had shown remarkable calmness throughout the trial, was completely overcome and lie would have fallen in the dock had not two warders stepped forward and supported him. berg is 26 years old and lived 1 Manhattan avenue. Joseph Rocco, an lS-year-otd gunman, of 10S Frost street, who Wm seen to rid himself of a gun while running away from the scene of the shooting, was arraigned in the Manhattan avenue court yesterday afternoon. He was held without bail by Magistrate Steers. Both the prisoner and the victim of the bullet acknowledge that they had had trouble long before last night's affray. Friedberg claimed that he beat the Italian live months ago, but he refused to tell what caused the first light.

Bocco admitted that he was beaten, but that several of Friedberg's friends were on hand at the time of the first troublo to seo that Friedberg did not gut the worst of it. Tho wounded man told the police that he was walking along Broadway when the Italian atacked him. Two shots rang out and Friedberg crumpled up in a heap on the sidewalk. Rocco, hinging a gun from him, darted across Broadway down Lorimer street. He was not quick enough to escape the eyes of Patrolman Green of tho Stagg street station, who was staudlng a block away.

As Rocco fled down Lorimer street, Green was close to his heels. Drawing his gun, ho ordered the Italian to halt. Rocco only ran faster. Green fired twice and then closed in on tho running man who had not been touched by the bullets. There was a scuffle.

Rocco grappled with Green. Rocco was handcuffed and led to the corner where Friedberg surrounded by a throng of policemen and curious persons lay making light of his lnjujrles. "Is this the man who shot you?" asked Green pushing Rocco forward Into the light. "Never mind," Friedberg is said to have answered. "This is my affair.

I'll settle it myself." Tlia police are convinced that Jealousy over the affections of a woman was the roal cause of tho shooting, but thev cannot get either Friedberg or Rocco to confirm the suspicion. Rather than pay rental to store them outside of our building, we have decided to put them in the space occupied by these rebuilt pianos; but as the room is needed immediately, we have deducted what we would have to pay for the outside storage from the regular selling prices of these 24 Pianos, believing that the radical reductions, as soon as known, will give us the space by Tuesday Night.
