Joseph Burke, who pleaded guilty to a charge of having stolen a load of brick from a freight car standing on a siding in the Long Inland Railroad yards at Far Rockaway. in the court at that place last Tuesday and was held for the Court of Special Sessions, was discharged by Magistrate Gilroy yesterday, the case having been reopened on request of William F. Cunningham, a contractor of BajBwater.

When the case wag called yesterday, Cunningham did not appear' and Burke was discharged. It is said that Cunningnam learned that Burke was not to blame for the theft of the brick and that, ho wished to use him as wltneea in another case, the nature of which was not divulged. Then the sheriff announced that he would arrest the objectionable driver, so the latter put on speed of about fifty miles an hour with the sheriff after him.
