The long-standing tight between the Nassau Electric Railway Company and the persons who claim fee ownership in tho bed of Union street, whera part of the line is operated, resulted in partial victory ior the property owners yesterday when tho Appellate Division gave permission to John J. Boylan, an abutting owner, to take title from Mrs. Catharine Cabot, a street fee owner, and join in the legal battle in the courts. The Appellate Division records show that Boylan and Mrs. Cabot have an agreement to divide the proceeds of any judgment they may recover.

There was a goodly number present. The chapter was called off for the summer. A collation was served after the chapter closed. JUSTICE BENEDICT VPHELD. Appellate Division Sustains Decision In fuvor of Eafflo Savings.

The Appellate Division yesterday upheld the decision of Justice Benedict in the Supreme Court giving judgment in favor of the Eagle Savings and Loan Company In the suit brought against It by lngoe Maddus and Julia W. Maddus, who sought to have reformed a mortgage to make it conform to the terms of a contract In which lngoe agreed to pay $105.60 for ninoty-otght months in return for $8,800 utlvanced by the company. When his payments were nearly completed he was told that he owed nearly half as much as he had borrowed. Then he signed a straight mortgage "in full of all demands against the company," and Justice Benedict in giving Judgment pointed out. that whatever right he had were signed away in the so-called straight mortgage.
