It was his privilege, as well as that of all the veteran officers, to retire himself under the provisions of the Pension law, and it would, therefore, appear that oil the Commissioners had to do with his otter of retirement In their hands, was simply to accept him and place his name on the roll of pensioners. Under these circumstances it would appear somewhat singular that General Jourdan voted in tho negative on the question. HIS SEASONS FOB DOINO SO wero as follows Captain Smith was summoned to the Board room and many questions were propounded to him by the Commissioners. Among other things, ho was asked by General Jourdan If Ue would have requested to have been retired, if he had not first been ordered to pass through the ordeal of a medical examination.

To this he responded with an emphatio negative. Commissioner Pyburn then asked him if ho had not, previous to said order be ing issued told him (the commissioner) that it was his intention to retire at the end of the year. Captain Smith denied that he had done so but Mr. Pyburn is positive that ho did and that tho Captain la mistaken about the matter. As it seemed that according to tho Captain's way of thinking when before the Board, that his retirement was being forced, General Jourdan voted iuiv.
